•  En caso de bajada en playa si no se presenta a la hora indicada no nos hacemos responsables de su regreso.
• A bordo de la embarcación en todo momento deberá hacer caso a las indicaciones entregadas por nuestro personal.
•  No nos hacemos responsables por objetos extraviados, olvidados y/o mojados. Al recibir este boleto está aceptando nuestros términos y condiciones. 
• Es responsabilidad del cliente llegar por lo menos 15 minutos antes del inicio de su actividad. En caso de perder el tour deberá comprar un nuevo boleto.

Políticas de cancelación 

• Cualquier cambio o  cancelación  deberá solicitarse con anticipación mínima de 24 horas antes del inicio de su actividad, de lo contrario se considera  “NO SHOW”. 
• En caso de perder el tour por no obedecer con las indicaciones que se estipulan en este recibo no se otorgará reembolso alguno.
•  Todos los pasajeros dentro de la reservación que no se encuentren presentes (NO SHOW) estarán sujetos al pago del 100% de su boleto. 
• Excursiones no tomadas no serán reembolsables.
• En caso de que necesite realizar un cambio, se cobrará una tarifa del 15% por actividad.
• Recuerde que debe traer este boleto con usted al momento de realizar check in o en caso de transportación al momento del pick up; este es su boleto.

RENUNCIA VOLUNTARIA DE LA RESPONSABILIDAD, ACUERDO DE INDEMNIZACIÓN Y MANIFESTACION DE ASUNCIÓN DE RIESGOS TERMINOS Y CONDICIONES.

Yo, el suscrito, por mi propio derecho y por permitir que los individuos abajo nombrados participen en cualquier tipo de “Actividades” (termino que se define mas adelante), por este medio libero y descargo por siempre, y convengo en no ejercitar ningun tipo de accion legal en contra de ENVA TOURS, S. DE R.L. DE C.V. y/o los subsidiarios, sus dueños, los operadores, los representantes, los oficiales, los empleados, los agentes, los cesionarios, los inversionistas, los accionistas, los instructores y/o los contratistas independientes (en lo sucesivo “Entitades Liberadas”), por cualquier tipo de responsabilidad y/o reclamo(s) que surjan a consequencia de daños y perjuicios, lesiones, accidentes o enfermedades (incluyendo inhabilidad o muerte), gastos médicos o de salud, daños materiales o la pérdida de estos, que puedan surgir en el presente o en el futuro derivado de mi participación en las “Actividades”, aunque las demandas se presenten por negligencia o falta de cuidado de cualquier parte incluyendo las “Entidades Liberadas”, condiciones climáticas, riesgos sanitarios generados por epidemias y/o pandemias, la responsabilidad por la fabricación de un producto, la falta de advertencia, o cualquier otra teoría de la responsabilidad. Asimismo, comprendo que tales riesgos existen y depende completamente de mi compromiso para reducir la posibilidad de un incidente. Las “Actividades” incluyen de manera enunciativa pero no limitativa cualquier tipo de deporte acuático, paseo de agua o terrestres, incluyendo las operadas con motor, actividades peligrosas o de riesgo, uso de instalaciones de las “entidades liberadas”, participación en programas de instrucción y/o reuniones técnicas, administrativas, demostrativas o de cualquier naturaleza que impliquen contacto, directo o indirecto con las “Entidades Liberadas” y/o cualesquiera de los servicios proporcionados por las “Entidades Liberadas”. Acuerdo pagar todos los gastos incurridos en las “Actividades” y pagar cualquier daño, destrucción, uso erróneo o pérdida de equipo como resultado de mi participación durante las “Actividades”. Las “Entidades Liberadas” se reservan el derecho de cancelar totalmente o de forma parcial las “Actividades” debido al mal tiempo, a las condiciones desfavorables del océano, por restricciones realizadas por autoridades sanitarias, o a otros actos de dios o de fuerza mayor. Si tal es el caso, los gastos incurridos previamente serán reembolsados sujeto a cualquier gasto administrativo incurrido. También acuerdo indemnizar, defender, y sostener sin responsabilidad a las “Entidades Liberadas” por cualesquiera y todo tipo de accion legal, procedimientos, gastos, costos, daños y responsabilidades, incluyendo los honorarios legales, (si es judicial o extrajudicial) por lesiones o daños (incluyendo la muerte) incurridos en su totalidad o forma parcial como como resultado de mi participación en las “Actividades” y a reembolsarlas a este por cualesquier tipo de gastos incurridos. Si yo o mis herederos, los ejecutores y/o mis administradores deciden perseguir algun tipo de accion legal, mediante el presente instrumento renuncio a cualquier tipo de jurisdicción que por mi domicilio actual o futuro pudiere llegar a aplicar, estando de acuerdo en sujetarme unicamente a las leyes, tribunales y jurisdicción de Cabo San Lucas, Estado de Baja California Sur, territorio de los Estados Unidos de México. En Cabo San Lucas, Baja California Sur, México, reconozco por este medio que las “Entidades Liberadas” me han informado fehacientemente de todo el riesgo inherente que mi participación en las “Actividades” puediere llegar a implicar y por lo tanto accepto en su totalidad el contenido y el alcance legal del instrumento presente, en razon de tal firmo el presente sin ningun tipo de defecto o vicio que pudiere llegar a afectarlo total o parcialmente. También, como padre, madre o tutor de los menores, declaro que tengo capacidad jurídica para firmar el presente instrumento y para otorgar mi autorización a efecto de que el menor o los menores antes mencionados participen en las “Actividades”. Reconozco que es mi responsabilidad saber los límites físicos y/o los límites de los menores a mi cargo, asumiendo, todos estos riesgos; asimismo otorgo a las “entidades liberadas” el derecho absoluto e irrevocable y permiso irrestricto respecto a los retratos fotográficos, editoriales o cualquier fotografía o recuerdo que se me haya tomado o se le haya tomado de mi menor niño con el conocimiento de estas fotografías o recuerdos son para usos promociones o publicidades, pero no son para usos de distribuciones comerciales; por ultimo, por mi propio derecho y en representación del menor o menores acepto los términos y condiciones del presente He leído esta Renuncia Voluntaria de la Responsabilidad, Acuerdo de Indemnización y Manifestacion de Riesgo Asumido y declaro que accepto completamente los términos y las condiciones del mismo. Reconozco que estoy firmando este acuerdo libre y voluntariamente, que tengo capacidad juridica para firmar este acuerdo, y que libero con mi firma completamente e incondicionalmente a las “Entidades liberadas” de todo tipo de responsabilidad tan amplia como en derecho sea necesario.

VOLUNTARY WAIVER OF LIABILITY, INDEMNITY AGREEMENT & ASSUMPTION OF RISK TERMS AND CONDITIONS.

I, the undersigned, on my behalf and also to permit the below named individual(s) to participate in any way in any of the “Activities” (as they are later herein defined), do hereby release, waive, forever discharge, and covenant not to pursue any legal action against ENVA TOURS, S. DE R.L. DE C.V. and/or subsidiaries, together with its owners, operators, representatives, officers, employees, agents, brokers, assignees, investors, stockholders, instructors and/or independent contractors (herein after the “Released Entities”), for liability of all rights and claims for any personal injury, accident or illness (including disability or death), medical or health expenses, costs or damages, including property damage or loss, which may arise now or in the future for any reason from my participation in any of the “Activities”, whether such claims arise from the negligence of any party, including the “Released Entities”, weather conditions, sanitation and health risks generated by epidemics and/or pandemics, products liability, failure to warn, or any other theory of liability. Likewise, I acknowledge that any of these risks exists and depends on my commitment to reduce the possibility of any incident. The “Activities” includes but is not limited to any type of aquatic sports, fitness, yoga, meditation, camping and retreat activities, motor operated included, dangerous or risky activities, use of the facilities of the “Released entities”, participation in instruction programs and/or technical meetings, administrative, or demonstrations of any nature which involve direct or indirect contact whit any of the “Released Entities”, and/or any of the services provided by any of the “Released Entities”. I agree to pay all fees charged for the “Activities” and to pay for any damage, destruction, misuse, or loss of equipment as a result of my participation during the “Activities”. The “Released Entities” reserve the right to cancel any or all of the “Activities” due to inclement or impeding bad weather, unfavorable conditions of the ocean, restrictions implemented by health authorities, or other Acts of God or force majeure. If such is the case, fees previously paid will be reimbursed subject to any administrative incurring fees. I also agree to indemnify, defend, and hold harmless the “Released Entities” from and against any and all claims, actions, suits, demands, proceedings, costs, expenses, damages and liabilities, including legal fees, (whether judicial or non-judicial) for injuries or damages (including death) incurred in whole or in part as a result of my participation in the “Activities” and to reimburse them for any such expenses as they are incurred. Should I or my heirs, executors and/or administrators decide to pursue litigation despite this release of liability, I hereby waive any jurisdiction that by my current or future domicile or that by any other circumstance could apply, being in full agreement to be bound only by the laws, courts and jurisdiction of Cabo San Lucas, Baja California Sur, Mexico. In Cabo San Lucas, Baja California Sur, Mexico I hereby acknowledge that I have been fully informed by the “Released Entities” of all the inherent risk that my participation in the “Activities” may involve and therefore fully understand the contents and legal scope of the instrument herein and thereby undersign this instrument stating it was not forced or subject to any type of defect that could nullify it in whole or in part. Also, as a parent or mentor of the minor(s) named herein, I hereby declare that I am legally capable to sign this agreement and to grant my permission for the minors signaled below to participate in the “Activities”. I acknowledge that it is my liability to know the physical limits of myself and about the minors on my care, assuming all of these risks; likewise, I grant to the “released entities” the absolute and irrevocable and unrestricted permit and authorization regarding to the photos, portraits, pictures, or any photo or souvenir that has been taken or made from me and/or on the minors on my care, granting the authorization to use these photos or souvenirs for promotional or advertising purposes, not for commercial distribution. And further I agree, individually and on behalf of the minors, to the aforementioned terms and conditions. I have read this Voluntary Waiver of Liability, Indemnity Agreement & Assumption of Risk and I fully understand the terms and conditions set herein. I acknowledge that I am signing this agreement freely and voluntarily, that I am legally capable to sign this Agreement, and intend by my signature to be a complete and unconditional release of all the liability, and to be as broad and inclusive to the fullest extent allowed by law.
